California Labor Law Update: Recent Court Decisions Favor Employers

The State of California is notorious for its liberal, pro-employee court system and complex employment regulations. Labor laws in California typically favor employees, and employers have paid billions in settlements for a range of violations, such as wage and hour infractions, discrimination and wrongful termination. However, several high profile court cases in California recently favored the employer, providing some relief to the constant barrage of employment lawsuits.

In one case, a mentally troubled employee made threatening remarks to other employees working for the City of Orange County, California. She was fired, and sued for disability discrimination. The Appellate Court ruled in favor of the employer, stating that an employer may discipline an employee for engaging in threats or violence against coworkers, even when that behavior is caused by the employee's disability.

The good news for employers is that if an employee is violent, makes threatening statements, or is in clear violation of company policy, they should not be afraid to take action out of fear of violating disability discrimination - their obligation to maintain a safe work environment for the other employees takes precedence.

In the next case, a California-based employee was caught using a company computer for personal use, in particular to make contact with an attorney on private matters. The employer found the emails and later used the content against the employee in court. The case moved its way through the California court system, and was eventually heard by the United States Supreme Court. The High Court found in favor of the employer, explaining that where an employer has a policy that e-mail can be inspected at any time, employees do not have a reasonable expectation of privacy in their company email account.

In a third case, a police department in the Municipality of Ontario, California gave employees pagers on which text messages could be sent. It later reviewed the messages - many of which were personal and sexually explicit - to determine why monthly use was so high. The Supreme Court held that, even assuming that the employees had a reasonable expectation of privacy in the messages, review of those messages did not violate the Fourth Amendment. The government employer's search was motivated by a legitimate work-related purpose and was not excessive in scope, and therefore was reasonable under existing precedent. Similar to the previous case, the US Supreme Court determined that employers are permitted to check emails and text pagers if they were work-related searches.

Finally, in one of the most anticipated lawsuits of the year, 1.6 million female employees of Wal-Mart claimed they worked in a culture of gender discrimination. They filed a class action lawsuit against Wal-Mart, the largest sexual harassment lawsuit in history! The California Ninth Circuit of Appeals court found in favor of the class action, and the case was brought to the US Supreme Court. The Supreme Court overturned the Ninth Circuit, stating that the employees had the right to pursue their own personal lawsuits, but that the class action lacked "common elements".

While there is not doubt that labor laws in California still lean towards the employee, employers operating in the state can breath a slight sigh of relief in light of these recent court decisions. A word of caution, however, to never let your guard down when it comes to employment practices. Unfortunately, the chances are relatively high that the next California employment lawsuit is just around the corner.

Houston has always been a boom or bust economy. Yet it is America's third largest city with 5.5 million people. The ten-year economic cycles have been caused by oil price fluctuations. But as Houston diversifies its economy and matures it employs larger and larger percentages of folks in retail and service sectors. Albertson's pulled out of the Houston Market, Wrath left by Enron, Arthur Anderson Collapse, Continental Airline Lay offs, HP-Compaq merger and all the oil mergers just prior. Last year there was an article in the Houston Business Journal of the anchor store in many shopping centers through out Houston pulling out. Kmart, took out some stores, so did three other big box stores and a few consumer electronics places and larger furniture stores, now Albertson's has left. Who gets hurt? The franchise stores who pay a high price and lease to be in those centers along side a big anchor tenant. Think about it, Albertson's with their large super stores with Banks in side, Starbucks coffee, bakery, mini eating area, film developing and pharmacy.

If you are a franchise store and are in a ten-year lease and your anchor tenant up and moves, you are left holding the bag and with less traffic in the mall, sales will go down until eventually you file bankruptcy, jump out a window or drown (especially on Houston's East Side-Flooding). Many small business people lose fortunes when anchor tenants moves, demographics in the area shift or economies go through cycles. Houston is on the rebound and times are good again, so is growth in all the suburbs, but one does not have to look too far through the recent periods to see the city is changing and the cycles are still remaining. Think about it; location, location, location.

The other day, I was speaking to a group of friends about what might happen if Obama happens to get reelected. We discussed the last four years and mismanagement of our government, our military, our economy, and diplomatic efforts. We wondered if the country could handle four-more years of this. We all agreed that it could but it would be a real bad place to take our great nation. Next someone wondered if it made sense to just impeach the gentleman, which would be feasible if we had a strong majority in both the House of Representatives and the US Senate. Okay so, let's talk shall we?

Now then, as much as PETA would be on board we cannot probably impeach the president for kicking the first pet, Bo. But, the president wouldn't be able to prove he didn't kick the dog either. Still, there are some serious issues with regards to the $90 billion wasted in alternative energy projects, where deals were made to political insiders and crony capitalist friends who either before or after donated huge sums of money to the Obama Campaign organizations.

Next there is the covert operation gone bad in Benghazi Libya, where first the Administration lied to the American people, then the State Department, and then the CIA while the Administration seems to be now trying to hang former high-ranking military men, admirals and captains of aircraft carriers, and multi-stared generals in theater. So, something big is up, and we need to get to the bottom of it. Further, the way the White House is acting far too many people know the truth, while the American people are still being lied too. There is definitely an impeachable offense somewhere in all of that.

How about misuse of government taxpayer's money for flights on Air Force One to late night talk show appearances, or falsified expense reports at the White House, also impeachable offenses, also rather easy to prove, unlike the recent charges of voter fraud in Missouri, PA, OH, MI, NH, and/or VA and NJ. Either way, whether purely speculative or something sinister behind the scenes, with a Republican majority in both houses, President Obama may find himself out of a job another way, one far less flattering than merely losing an election like Jimmy Carter did.

It's a lot easier to save face by losing an election, but public humiliation of impeachment and then being thrown out of office like Richard Nixon was, that certainly would be something wouldn't it? Please consider all this and think on it.

What Are Thematic Units?

Thematic units are a multi-disciplinary approach to teaching based on a common theme or topic. Multi-disciplinary simply means, "of or relating to many different subject areas." Pilling a Cat

Pilling a cat can be a "nightmarish" experience. Cats don't want something pushed down their throats, and they'll fight with all their might to prevent it. In fact, it's amazing how powerful their small bodies can be. Here are some ways to make the pilling process easier and less stressful - for both you and your cat.

The easiest way of pilling a cat is to crush the pill into a powder by using mortor & pestle or by putting the pill between two spoons. Then mix the powder with a small amount of wet food (preferably a preservative free, healthy wet food). If your cat usually eats dry food, she will probably view the wet food as a treat and eat it up.

If the medication is a capsule, just pull the capsule apart, sprinkle the contents on the wet food, & mix, & serve.

If your cat won't eat the wet food that contains the pill or if she is too ill to eat, you can get a "pill gun", also called a "pet piller", from your veterinarian. This is a plastic rod with little rubber cups on the end that hold the pill until a plunger is pressed. It's best to get a long gun with a soft tip.

Your vet can show you how to use the pill gun, but here are some basic instructions. Getting your cat's mouth open is going to be the most difficult part. First, be sure the pill is in a handy place. You can put your cat on a bookshelf with her bottom in a corner or you can put her on your lap firmly braced. Have your cat facing to the right if you're right handed, & vice versa. With your left hand, grip your cat at the cheekbones, putting your palm at the top of her head. Keeping your finger off the trigger, with your right hand, insert the pill gun until the pill is positioned over the tongue & open throat. Then pull the trigger & withdraw the gun quickly. Be sure to give your cat a treat directly after giving the pill.

If you don't feel comfortable using a pill gun, you can try giving the pill by hand. Extend your cat's head backwards just far enough so that her nose is pointing towards the ceiling. At this point, most cats will slightly open their mouths. With the little finger or ring finger of the hand holding the pill, open the bottom jaw a little more. You may need to hold her top jaw with your other hand while doing this. Aim straight and lightly throw the pill or drop it so that it hits beyond the hump in her tongue. (Be sure to drop or lightly throw the pill rather than shoving it down so that your cat is not as likely to gag and so that you lessen your chance of getting bitten.) Most cats will then instinctively swallow the pill.

In case none of these "pilling" strategies work, as a last resort try to find a compounding pharmacy, and have them make flavored liquid or gel out of the medication.

The Letter Writer - Book Review

I enjoyed reading this book. The characters were portrayed very well. Jack, a multimillionaire who experiences mid-life crisis and ends up finding meaning to his life - but it costs him millions of dollars and emotional pain. Adele is a heavy-drinking, free-living, multimillionaire with an independent mind and a sense of humor. Wendy, a single mother who finds the love of her life. Mixed up educators playing with their students' lives in their conquest and the retiring professor who resists this plot has a big secret. A married advisor carries on an affair with another man and when he is discovered, he thinks his world has ended.

I would say this fiction is a light comedy that is quite entertaining and has some romance elements as well. Author Robert Mercer-Nairne brings attention to common human frailties with a sense of fun. He clearly reveals the desire to 'get rich quick' in North American Society. Members of this society tend to hear what we WANT to hear and perceive the greener pasture out there somewhere -rather than in the here and now.

Readers are shown the foolishness of following others blindly and the danger of where our greed can take us. Innocents can have their life irrevocable altered by someone else's desire to climb a corporate or social ladder. The benefit of spiritual leaders to help ground the characters in this novel, helping them learn to forgive themselves and move on in life is used at several points in the story.

I recommend this book for anyone looking for a light, entertaining read.

If you want an easy way to get consistent web traffic, get a steady stream of email opt-in subscribers, and make repeat passive sales, then you can think about giving away or even selling a digital eBook or an information product online.

You can sell it on your own in PDF format, or you can have some other service such as Amazon Kindle Direct Publishing sell it for you.

Which should you use? The answer is you should use both.

A very easy way to share some kind of information like a how-to manual, a guide, or a report is to distribute it as a PDF document. This is the standard for shared information on the internet. All you have to do is type up whatever information you want into a Word Document. This can include text, tables, images and so on, and then when you go to save it, choose file, save as PDF and it will save it as a PDF file.

These instructions can be anything from how to run ten miles without stopping, how to lose ten pounds, how to flip a house, any kind of information people are willing to pay money for, you can sell online.

You can also give away a free report which is very similar, it just means that you have your download page once again, and you have not a sales letter but an opt-in page, a page that explains your free report. And instead of having a PayPal button, instead of asking someone to buy, you have an email sign up form.

You can sign up for an auto-responder at a service such as AWeber.com, and what happens is when someone fills in their first name and email address they are then redirected to that download page where they can download their PDF report.

Whether you're giving a report or selling it, it's always a good idea to place it on Amazon Kindle as well so you can make sales directly from Amazon. Amazon takes either 35 or 70 percent depending on which model you choose, and again all you have to do is provide Amazon.com with your Word Document and they will format it for reading on any Kindle device, which includes the Kindle itself and the iPhone, iPad Droid device, or even a Mac or a PC.

If you are thinking about making money online and selling your information, all you have to do is save as a PDF, put it online somewhere, and decide whether you're going to charge money for it or give it away in exchange for an email opt-in.
